ACCEPTANCE OF THESE TERMS
By accessing or using fortresscyphysec.com (the "Site"), you agree to these Terms of Use and Disclaimer. If you do not agree, do not use the Site.
INFORMATIONAL PURPOSES ONLY
The content on this Site is provided for general informational purposes about Fortress and our services. It does not constitute security, compliance, legal, engineering, or professional advice, and it is not a substitute for an assessment of your specific environment.
Security requirements depend heavily on facts — your facilities, systems, threat profile, contractual obligations, and regulatory posture. Nothing on this Site should be relied upon as a recommendation for your particular circumstances.
No advisory relationship is created by visiting the Site, submitting the contact form, requesting a consultation, or corresponding with us. A Fortress advisory relationship begins only upon execution of a written engagement agreement signed by both parties.
SUBMISSIONS ARE NOT CONFIDENTIAL
Information you submit through the Site's public forms or send by unencrypted email is not treated as confidential and is not protected by any duty of confidentiality until a written agreement or non-disclosure agreement is in place between us.
Do not submit classified information, Controlled Unclassified Information (CUI), credentials, system diagrams, vulnerability findings, or other sensitive security material through this Site. Where an engagement requires the exchange of sensitive material, we will establish an appropriate secure channel first.
COMPLIANCE FRAMEWORKS AND OUTCOMES
References on this Site to CMMC, NIST SP 800-171, Interagency Security Committee standards, or other frameworks describe areas in which Fortress advises. Fortress does not guarantee any certification, accreditation, authorization, assessment score, audit result, or contract award. Those determinations rest with the relevant assessor, authorizing official, or government authority, not with Fortress.
ACCURACY AND NO WARRANTY
We make reasonable efforts to keep Site content accurate and current, but standards and requirements change. Content may become outdated and may contain errors or omissions.
THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OR ERROR-FREE OPERATION.
INTELLECTUAL PROPERTY
The Site and its content — including text, graphics, logos, and the Fortress name and marks — are owned by Fortress or its licensors and are protected by intellectual property laws. You may view and print Site content for your own internal, non-commercial reference. You may not reproduce, republish, distribute, or create derivative works from Site content without our prior written permission.
ACCEPTABLE USE
You agree not to use the Site for any unlawful purpose; attempt to gain unauthorized access to the Site or its underlying systems; probe, scan, or test the vulnerability of the Site without our prior written authorization; interfere with the Site's operation; or use automated means to scrape or harvest content or contact information.
LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORTRESS AND ITS ADVISORS, MEMBERS, OFFICERS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.
Liability arising from a paid engagement is governed by the limitation-of-liability provisions of that engagement agreement, not by this section.
INDEMNIFICATION
You agree to indemnify and hold harmless Fortress and its advisors, members, officers, employees, and contractors from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site or your violation of these Terms.
GOVERNING LAW AND VENUE
These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-laws principles. Any dispute arising out of these Terms or the Site shall be brought exclusively in the state or federal courts located in Jackson County, Missouri.
THIRD-PARTY LINKS
The Site may contain links to third-party websites. We do not control and are not responsible for the content, accuracy, or practices of those sites. Links do not imply endorsement.
CHANGES TO THESE TERMS
We may revise these Terms at any time by posting an updated version on this page and revising the effective date above. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
SEVERABILITY
If any provision of these Terms is held unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
